1. Acceptance of Terms

By accessing or using the Smacked Hits platform (“Service”), you agree to be bound by these Terms of Service. If you do not agree to all of the terms and conditions, you may not access or use the Service. We reserve the right to update these terms at any time, and your continued use of the Service after changes are posted constitutes acceptance of those changes.

2. User Accounts

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. Smacked Hits reserves the right to suspend or terminate accounts that violate these terms.

3. Purchases & Wallet

All purchases on Smacked Hits, including pack openings, marketplace transactions, and membership subscriptions, are conducted through your Smacked Hits wallet. Funds added to your wallet are non-transferable except as permitted through platform features such as sell-back and marketplace sales. Prices are listed in US dollars and are subject to change without notice.

4. Pack Openings & Digital Goods

Pack openings are final once initiated. Each pack contains a random selection of cards based on published odds. By purchasing and opening a pack, you acknowledge that results are randomized and that the specific cards received may vary. Digital goods, including pack openings, are non-refundable.

5. Intellectual Property

All content on the Smacked Hits platform, including but not limited to text, graphics, logos, images, and software, is the property of Smacked Hits or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on this platform without our prior written consent.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Smacked Hits shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid to Smacked Hits in the twelve months preceding the claim.

7. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Any provisions of these terms that by their nature should survive termination shall remain in effect.

8. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts located in Delaware.
